BetterLife Express

The BetterLife Express programme has been put in place to reward all registered Partner Agency’s, Estate Agency Principals and Broker Owners for processing home loan lead applications (Direct and Cash Deals) through BetterLife Group. We want to reward YOU for your loyalty and hard work. We recognise that you are an integral part of our business success and this is our way of thanking you. You will be rewarded over and over again for supporting BetterLife Group. With each qualifying lead submitted through BetterLife group.

Definitions

  • In these terms and conditions the following shall have the meanings assigned to them unless inconsistent with or otherwise expressly indicated by the context:
  • "BetterLife Home Loans" or "Company" means BetterLife Home Loans Proprietary Limited, registration number 1996/016233/07
  • "Lead" means all cash and direct home loan applications loaded onto the BLHL (BetterLife Home Loan) BetterLife Express system
  • "Card" means the gift card containing a data storage magnetic strip / barcode that may under certain circumstances be issued to members of the Rewards Programme
  • "Rewards Programme" or "BetterRewards" means the BetterLife Home Loans loyalty and rewards programme called BetterRewards by which Members are rewarded
  • "Member" means a person accepted by the Company as a member of the Rewards Programme, who is party to and bound by these terms and conditions
  • "Rewards Points" means the points credited or awarded to Members through the Rewards Programme.

Limitation of liability

  • The company shall not be liable to any member for any consequential or other damages, whether direct or indirect, associated with the Rewards Programme
  • Termination or suspension of the Rewards Programme
  • Inability to credit or debit Rewards due to circumstances beyond its control, such as for example the Rewards website being offline
  • Any delay in replacing a lost or stolen card or any unauthorized use of the card
  • Any failure by a member to inform the Company that a transaction is subject to the Rewards Programme.

Warranties

Subject to the provisions of the Consumer Protection Act number 68 of 2008, the Company gives no warranties not accepts liability, of any nature whatsoever, for any claims, loss or damage from any cause arising out of or in connection with the supply of goods and services related in any way to the Rewards Programme.

Transferability

Cards are not transferable, remain the Company’s property and may not be redeemed for cash. Cards and / or rights which the Cards confer may not be alienated, sold, transferred, pledges, assigned or dealt with in any other manner except as set out in these terms and conditions.

General

  • Any indulgence granted by the Company to any Member shall not constitute a waiver of its rights against the Member and the Company shall not thereby be precluded from exercising its rights against any member concerned, whether having arisen in the past or arising in the future.
  • The Company reserves the right without prior notice to Members to amend these terms, including the right to amend the ration of Rewards Points to purchase and claim procedures and terminate the Rewards Programme.
  • The Company reserves the right to cancel the Rewards Programme in its entirety upon 2 (two) months’ notice to the Member. The Company shall give the Member notification of such cancellation by any means of communication, including mail, statement, facsimile, electronic mail, Short Message System (SMS) or through any other medium that the Company may deem fit. All points earned by the Member up until the date of cancelation will be redeemable by the Member for a period of 2 (two) months thereafter, where after such unredeemed points shall be forfeited to the Company.
  • The information contained in these terms and conditions are provided for general information only and do not constitute any form of advice. The Company accepts no responsibility for the accuracy of any particular statement nor accepts liability for any loss, cost or expense which may arise from reliance on the information contained in these terms and conditions.
  • Rewards Points are not transferable from one participant to another. Points are not redeemable / exchangeable for cash. Points are exchangeable for cash out only by requesting funds to be loaded onto the BetterRewards MasterCard. The MasterCard cannot be used at an ATM to draw cash and cannot be used for cashback at retailer.
  • The availability of products in the catalogue cannot be guaranteed at all times. All product descriptions in the online catalogue are based on information sent to us by the manufacturer.
  • Participants must comply with relevant income tax regulations and will be issued (upon request) by the programme administrators with a redemption statement. BetterLife Group assumes no income tax liability.
  • Installation, service or rental costs are not included in the Rewards Points value. Batteries are not supplied with goods.
  • The administrators reserve the right to take the website offline for a limited time, if necessary, for upgrading or maintenance without prior notice or compensation.
  • Neither the sponsoring company, not BetterRewards will be held liable for damage to electrical equipment caused by power surges nor lightning, such damages are not covered by manufactures warranties or guarantees.
  • All product prices are subject to change without prior notification. Unless otherwise provided, Incentive points cant be purchased, only earned.
  • In effecting any transaction on behalf of a Member the Company shall not act nor shall it be deemed to be acting neither as the Members agent nor as the agent of any partner.
  • Copyright in all materials made available through the Rewards Programme is owned either by the Company and / or the partners and protected by both national and international intellectual property laws. Accordingly, any unauthorized copying, reproduction, retransmission, distribution, dissemination, sale, publication, broadcast or other circulation or exploitation of any such material will constitute an infringement of that copyright. The trademarks, logos and service marks displayed relating to the Rewards Programme are registered and unregistered trademarks of the Company and / or the partners. Nothing contained in the Rewards Programme should be construed as granting any license or right to use any trademark, logos or service marks without the written permission of the Company and / or the partners.
  • These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. The Member hereby consents to the exclusive jurisdiction of the appropriate division of the High Court of South Africa in respect of any dispute arising in connection with the Rewards Programme, or these Terms and Conditions or any matter related to or in connection therewith.
  • Otherwise than as required by law, the Company shall not be responsible for issuing any tax or other certification, clarification or directive to the Member or the partner or any third party or be responsible for any tax liability or other Government charge arising from the Rewards Programme. Should the Member donate points to any partner which is a charitable or other institution, the Member acknowledges that she / he will not derive any taxable benefit in making such donation.
  • The Member waives any rights she / he may have or obtain against the Company arising directly or indirectly from any loss or damage of whatsoever nature, which the Member may suffer as a result of the Rewards Programme, the redemption of points, any reward or voucher or matter incidental thereto or the acts or omissions of any partner and agrees that the Company is not responsible for any death or injury or direct or consequential loss or damage (including loss of profits or data) arising from the Rewards Programme.
  • The Member accepts that the Company may in its sole and absolute discretion from time to time amend, replace, withdraw or substitute the Rewards Programme, or suspend any of the partners or any aspect thereof or the Terms and Conditions relating thereto despite such action affecting points already accumulated. The Company shall give the Member notification of such amendment by any means of communication, including mail, statement, facsimile, electronic mail, Short Message System (SMS) or through any other medium that the Company may deem fit.
  • Any communication contained on the Company website will be deemed to be sufficient communication or notice relating to the Rewards Programme and shall be binding on the Member.
  • The Company shall be entitled without notice to the Member to cede any or all of its rights under these Terms and Conditions to any entity within the Company group of companies.
  • The Company does not make the representation that information and materials on this site are appropriate for use in all jurisdictions available on the web, or that transactions, securities, products, instruments or services offered on this site are available or indeed appropriate for sale or use in all jurisdictions, or by in all jurisdictions, or by all investors or other potential clients. Those who access this site do soon their own initiative, and are therefore responsible for compliance with applicable local laws and regulations. By accessing each site, the entrant has agreed that he / she has reviewed the site in its entirety including any legal or regulatory rubric.
